Standard Terms and Conditions for Holiday Rentals

Book Jervis Bay is operated by Brunswood Pty Ltd.

These Standard Terms and Conditions apply to all holiday rental bookings made through Book Jervis Bay. By confirming a booking, the Guest agrees to comply with these Terms and Conditions for the duration of their stay.

Please read these Terms and Conditions carefully. If you have any questions, please contact the Book Jervis Bay Holiday Team prior to confirming your booking.


1. Definitions

For the purpose of these Terms and Conditions:

“Booking” means the reservation made by the Guest for the occupancy of a Property for a specified period.

“Property” means the holiday accommodation booked by the Guest, including all fixtures, fittings, furniture, appliances, equipment, gardens and outdoor areas.

“Owner” means the legal owner of the Property.

“Agent / Agency” means Book Jervis Bay, a division of Brunswood Pty Ltd, acting as the managing agent for the Property.

“Guest” means the person who makes the Booking and all persons approved to stay overnight at the Property during the Booking period.

“Visitor” means any person visiting the Property during the Booking period who is not included as an overnight Guest.

“Terms and Conditions” means these Standard Terms and Conditions together with any additional conditions applicable to the Property or Booking.


2. Acceptance of Terms

By making a Booking with Book Jervis Bay, the Guest acknowledges and agrees that they are being granted a licence to occupy the Property for holiday purposes only and for the agreed Booking period.

The Guest agrees to:

  • comply with these Terms and Conditions;
  • comply with all reasonable instructions provided by Book Jervis Bay;
  • ensure all Guests and Visitors comply with these Terms and Conditions.

Any breach of these Terms and Conditions may result in:

  • termination of the Booking;
  • immediate eviction from the Property without refund;
  • forfeiture of the security bond;
  • recovery of additional costs, damages or losses;
  • reporting of serious incidents where required.

Book Jervis Bay reserves the right to take further action, including lodging claims through appropriate legal channels where necessary.


3. Booking Confirmation and Payment

A Booking is not confirmed until the required deposit payment has been received by Book Jervis Bay.

Unless otherwise stated:

  • A deposit of 50% of the total booking amount is required to secure a reservation.
  • Where a Booking is made within 30 days of arrival, the full booking amount must be paid at the time of booking.
  • Final payment is due 30 days prior to arrival.

Failure to make payments by the required due dates may result in cancellation of the Booking and forfeiture of any payments made.

Book Jervis Bay reserves the right to decline or cancel any Booking where payment requirements are not met.


4. Booking Fees and Third-Party Fees

A once-off booking fee of $50.00 applies to each direct booking made with Book Jervis Bay.

Where a Booking is made through a third-party booking platform, additional fees, commissions or charges may apply. These charges are determined by the third-party provider and are separate from Book Jervis Bay fees.

Third-party booking fees, service fees or charges are generally non-refundable and remain subject to the terms and conditions of that booking platform.


5. Security Bond / Pre-Authorisation

A security bond may be required for each Booking depending on the Property booked.

The bond amount may be:

  • $50;
  • $500; or
  • $1,000.

The security bond will be processed as a credit card pre-authorisation on the day of arrival or the closest available business day.

A pre-authorisation is a temporary hold placed on funds by your financial institution and is not a payment unless a claim is required.

The pre-authorisation will generally be released within 7–10 business days after departure, subject to:

  • inspection of the Property;
  • confirmation there are no outstanding charges;
  • processing timeframes imposed by your financial institution.

The security bond may be used to cover, but is not limited to:

  • damage to the Property, furniture, fixtures or fittings;
  • missing items;
  • excessive cleaning requirements;
  • additional cleaning caused by the Guest or Visitors;
  • stained or damaged linen;
  • lost keys, access devices or remotes;
  • replacement of locks or security devices;
  • excessive rubbish removal;
  • BBQ or outdoor cooking equipment requiring additional cleaning;
  • unauthorised late departure;
  • after-hours call-out fees;
  • costs associated with breaches of these Terms and Conditions.

Where a claim is required, Book Jervis Bay will notify the Guest of the reason for the claim where reasonably possible.


6. Cancellation Policy

Cancellation terms vary depending on the booking channel and Property. Guests should review the cancellation terms provided at the time of booking.

For direct bookings with Book Jervis Bay:

Cancellation more than 60 days prior to arrival

A cancellation fee of $50.00 will apply, together with any:

  • non-refundable third-party booking fees;
  • payment processing fees;
  • credit card fees or charges incurred.

The remaining balance will be refunded.

Cancellation within 60 days of arrival

If Book Jervis Bay is unable to re-let the Property for the cancelled dates, all monies paid will be forfeited.

If the Property is successfully re-booked:

  • a cancellation fee equal to 15% of the total booking value will apply;
  • any applicable booking fees, third-party fees and payment processing fees will also be deducted.

Book Jervis Bay will make reasonable efforts to re-let the Property but does not guarantee that a replacement booking will be secured.


7. Cancellation by Owner or Agency

Bookings are accepted in good faith on behalf of the Property Owner.

In rare circumstances, including emergencies, unforeseen events, safety concerns, property unavailability or circumstances outside the control of Book Jervis Bay, it may be necessary to cancel or relocate a Booking.

Where this occurs, Book Jervis Bay will make every reasonable effort to:

  • offer alternative accommodation of a similar standard and location; or
  • provide a refund of monies paid where suitable alternative accommodation is unavailable.

Book Jervis Bay and the Property Owner will not be liable for additional compensation, travel costs, inconvenience or consequential losses arising from such circumstances.


8. Occupancy and Guests

The Property may only be occupied by the number of Guests stated on the Booking confirmation and advertised for the Property.

The Guest making the Booking accepts responsibility for ensuring all Guests and Visitors comply with these Terms and Conditions.

A reasonable number of day Visitors may be permitted; however:

  • the total number of people at the Property must not exceed the advertised capacity or approved occupancy limits;
  • Visitors must comply with all Property rules;
  • excessive gatherings, functions or events are strictly prohibited unless prior written approval has been provided by Book Jervis Bay.

Any breach of occupancy limits may result in immediate termination of the Booking, eviction from the Property and forfeiture of all monies paid, including the security bond.


9. Use of the Property

Properties managed by Book Jervis Bay are provided for holiday accommodation purposes only.

The Guest agrees that the Property will not be used for:

  • parties or functions;
  • weddings or events;
  • commercial activities;
  • unlawful activities;
  • activities that create excessive noise, disturbance or nuisance to neighbours.

Guests must respect the local community and surrounding residents at all times.

Noise levels must be kept to a reasonable level, particularly between:

9:00pm and 8:00am.

Complaints relating to excessive noise, parties, antisocial behaviour or disturbance will be taken seriously.

Where serious or repeated complaints occur, Book Jervis Bay reserves the right to terminate the Booking immediately and require Guests to vacate the Property without refund.

Where required, incidents may be reported to NSW Police or relevant authorities.


10. Property Descriptions and Facilities

Book Jervis Bay makes every reasonable effort to ensure Property descriptions, photographs and information provided are accurate and current.

Guests acknowledge that:

  • photographs are representative only and may vary due to changes in furniture, décor, landscaping or seasonal conditions;
  • properties may experience normal wear and tear;
  • views, gardens, wildlife, surrounding properties and environmental conditions may change;
  • Book Jervis Bay cannot guarantee uninterrupted access to facilities, services or amenities outside of its control.

Book Jervis Bay accepts no responsibility for circumstances outside of its reasonable control, including but not limited to:

  • weather events;
  • wildlife;
  • neighbouring properties;
  • internet outages;
  • utility interruptions;
  • road closures;
  • construction or maintenance works.

Guests are responsible for ensuring the Property meets their individual requirements prior to booking.


11. Linen, Towels and Supplies

Where linen is provided, the Property will include:

  • bed linen;
  • pillows;
  • blankets or bedding;
  • bath towels.

Beach towels are not provided unless specifically stated in the Property description.

Additional linen, towel changes or servicing during a stay may be arranged upon request and may incur an additional fee.

For stays longer than 7 nights, additional cleaning or linen services may be available at the Guest’s expense.

Where a Property description states that linen is not provided, Guests must supply their own:

  • bed linen;
  • towels;
  • personal items.

Guests are responsible for checking Property inclusions prior to arrival.

Book Jervis Bay provides an initial supply of essential items where applicable, however Guests are responsible for purchasing additional supplies required during their stay, including but not limited to:

  • toilet paper;
  • cleaning products;
  • personal toiletries;
  • household consumables.

12. Cleaning Requirements and Property Condition

A standard departure clean is included in the Booking price provided the Property is left in a reasonable condition.

Guests agree to:

  • remove all rubbish;
  • wash and put away dishes;
  • remove food from refrigerators and cupboards;
  • return furniture and items to their original position;
  • leave the Property tidy and secure;
  • follow any specific departure instructions provided.

Additional cleaning costs may be charged where excessive cleaning is required, including:

  • excessive rubbish;
  • dirty dishes or kitchen areas;
  • stains or damage;
  • pet-related cleaning;
  • excessive sand or mud;
  • removal of personal belongings;
  • unreasonable mess.

13. Rubbish and Waste

Guests are responsible for disposing of rubbish appropriately during their stay.

Book Jervis Bay provides information regarding local rubbish collection days and bin requirements where available.

Where rubbish exceeds the available bin capacity at departure, Guests may be charged for additional removal costs.

Guests must not leave rubbish:

  • beside bins;
  • in common areas;
  • on the street;
  • in outdoor areas of the Property.

14. BBQ and Outdoor Equipment

Where BBQs or outdoor cooking facilities are provided, Guests must ensure these are cleaned after use.

Failure to adequately clean BBQs or outdoor cooking equipment may result in a cleaning fee of $50.00 being charged.

Guests are responsible for any damage caused through misuse of outdoor equipment.


15. Check-In and Check-Out

Check-In

Check-in time is from 2:00pm on the day of arrival unless otherwise arranged.

Access arrangements may vary depending on the Property and may include:

  • key collection from the Book Jervis Bay office;
  • key safe access;
  • other approved access arrangements.

Arrival instructions will be provided prior to check-in.

Late arrivals must be arranged with Book Jervis Bay prior to arrival.


Check-Out

Check-out time is strictly 10:00am on the day of departure unless prior approval has been provided.

Guests must:

  • return keys, remotes and access devices as instructed;
  • vacate the Property by the nominated departure time.

Failure to depart on time may result in additional charges, including:

  • additional cleaning costs;
  • staff attendance fees;
  • loss of income where delayed access affects incoming Guests.

Lost keys or access devices may incur replacement charges.


16. Damage, Breakages and Reporting Issues

Guests must notify Book Jervis Bay as soon as possible of any:

  • damage;
  • breakages;
  • faults;
  • maintenance issues;
  • missing items.

Guests must not attempt repairs without prior approval.

If damage or issues are discovered after departure that were not reported during the stay, Book Jervis Bay reserves the right to hold the Guest responsible where appropriate.

Guests are responsible for damage caused by:

  • themselves;
  • members of their group;
  • Visitors;
  • pets;
  • negligence or misuse of the Property.

17. Security and Property Access

Guests agree to keep the Property secure at all times.

When leaving the Property unattended, Guests must ensure:

  • doors and windows are locked;
  • keys and access devices are secured;
  • security systems are used where provided.

If Guests become aware of any issue preventing the Property from being secured, Book Jervis Bay must be contacted immediately.

Book Jervis Bay retains the right to access the Property where reasonably required, including for:

  • inspections;
  • repairs;
  • maintenance;
  • emergencies;
  • safety concerns;
  • compliance purposes.

Where possible, reasonable notice will be provided.


18. Call-Out Charges

Where Book Jervis Bay staff members, contractors or tradespeople attend a Property due to an issue caused by the Guest, Visitor or misuse of equipment, the Guest may be responsible for all associated costs.

This may include:

  • after-hours attendance;
  • locksmith fees;
  • call-out charges;
  • unnecessary maintenance visits.

19. Smoking and Vaping

All Book Jervis Bay properties are strictly non-smoking and non-vaping, unless otherwise specifically stated.

Smoking or vaping inside any Property is strictly prohibited.

If a Guest or Visitor is found to have smoked or vaped inside the Property, the Guest may be responsible for:

  • additional cleaning costs;
  • deodorising treatments;
  • replacement of damaged items;
  • repair costs;
  • loss of income where the Property cannot be re-let.

These costs may be deducted from the security bond.

Guests must ensure cigarette butts and smoking-related waste are disposed of appropriately and must not leave waste in gardens, outdoor areas or surrounding properties.


20. Pets and Wildlife

Book Jervis Bay does not accept responsibility for wildlife or animals that may be present at or around a Property.

Guests should take appropriate precautions and supervise children and pets at all times.

Pet-Friendly Properties

Where a Property is advertised as pet-friendly, Guests must follow all pet rules and ensure pets are supervised and cared for responsibly.

The following conditions apply:

  • pet waste must be collected and disposed of appropriately;
  • pets must not damage gardens, lawns, furniture or Property fixtures;
  • pets must not be left unattended at the Property unless appropriately secured;
  • pets must not use beds, lounges, bedding or linen provided for Guests;
  • Guests are responsible for all cleaning, repairs or replacement costs associated with pets.

Any additional cleaning, damage, pest treatment or repairs caused by pets may be charged to the Guest and deducted from the security bond.

Non-Pet-Friendly Properties

Pets are strictly prohibited at Properties that are not advertised as pet-friendly.

If a Guest brings a pet into a non-pet-friendly Property without prior approval:

  • the Booking may be terminated immediately;
  • Guests may be required to vacate the Property without refund;
  • additional cleaning, pest treatment, damage repairs and loss of income may be charged;
  • the security bond may be forfeited.

21. Restricted Activities and Illegal Behaviour

The following activities are strictly prohibited at all Book Jervis Bay properties:

  • parties or unauthorised events;
  • fireworks;
  • firearms or explosives;
  • illegal drug use;
  • criminal activity;
  • deliberate or wilful damage;
  • unsafe or dangerous behaviour;
  • activities that create a nuisance, danger or disturbance to neighbours.

Any behaviour considered illegal or unsafe may be reported to NSW Police or relevant authorities.

Book Jervis Bay reserves the right to immediately terminate a Booking and require Guests to vacate the Property where illegal activity or serious breaches occur.

No refund will be provided where a Booking is terminated due to Guest misconduct.


22. NSW Short-Term Rental Accommodation Code of Conduct

Book Jervis Bay operates in accordance with the NSW Short-Term Rental Accommodation Code of Conduct and expects all Guests, Visitors and Property Owners to comply with their obligations under the Code.

By confirming a Booking with Book Jervis Bay, Guests acknowledge and agree that they must:

  • respect neighbours and the surrounding community;
  • comply with all applicable laws and regulations;
  • maintain reasonable noise levels at all times;
  • not engage in disruptive, offensive or unsafe behaviour;
  • ensure all Guests and Visitors comply with these requirements.

Guests acknowledge that excessive noise, parties, anti-social behaviour, damage to property or other breaches may result in:

  • immediate termination of the Booking;
  • removal from the Property without refund;
  • recovery of costs, damages or losses;
  • reporting of serious incidents to relevant authorities.

Book Jervis Bay reserves the right to take reasonable action to protect Property Owners, neighbours, Guests and the local community.

Guests may also be subject to consequences under the NSW Short-Term Rental Accommodation Code of Conduct, including restrictions on future bookings where applicable.


23. Swimming Pools, Spas and Water Safety

Where a Property includes a swimming pool, spa or water feature, Guests must comply with all safety requirements.

Guests acknowledge that:

  • children must be supervised at all times;
  • pool gates and barriers must remain secured;
  • safety devices must not be tampered with or removed;
  • Guests use pools, spas and water areas at their own risk.

Book Jervis Bay is not responsible for accidents, injuries or incidents arising from misuse or failure to follow safety requirements.


24. Property Amendments, Relocation or Unavailability

Book Jervis Bay accepts bookings in good faith on behalf of Property Owners.

In exceptional circumstances, including but not limited to:

  • emergency repairs;
  • safety concerns;
  • unforeseen property issues;
  • circumstances outside the control of Book Jervis Bay;

it may become necessary to relocate a Booking.

Where relocation is required, Book Jervis Bay will make every reasonable effort to provide:

  • alternative accommodation of a similar standard; and
  • accommodation in a similar location where possible.

If suitable alternative accommodation cannot be provided, a refund of monies paid may be offered.

Guests acknowledge that Book Jervis Bay is not responsible for additional expenses, travel costs, inconvenience or consequential losses arising from circumstances outside its control.


25. Price Changes

In rare circumstances, pricing errors or changes may occur between the time of Booking and arrival.

Where an incorrect tariff has been identified, Book Jervis Bay will contact the Guest and provide the following options:

  1. Pay the difference in the applicable tariff;
  2. Transfer the Booking to a similar Property at no additional cost where available; or
  3. Receive a full refund of monies paid.

26. Complaints, Issues and Maintenance Requests

Guests must notify Book Jervis Bay as soon as possible if they experience any issue during their stay.

This allows Book Jervis Bay and/or the Property Owner the opportunity to investigate and rectify the matter where possible.

Guests agree to:

  • provide reasonable access for inspections, repairs or servicing;
  • allow a reasonable opportunity for issues to be addressed;
  • communicate concerns during the stay rather than after departure wherever possible.

Complaints made after departure may limit Book Jervis Bay’s ability to investigate or rectify the issue.

No compensation or refund will generally be provided where:

  • the issue was not reported during the stay;
  • reasonable access was not provided;
  • the matter was outside the control of Book Jervis Bay;
  • the Guest chose to leave the Property early.

27. Disturbances Outside Our Control

Book Jervis Bay is not responsible for disturbances or disruptions caused by circumstances outside our reasonable control, including:

  • severe weather;
  • natural disasters;
  • emergency services activity;
  • power outages;
  • internet or telecommunications outages;
  • neighbouring properties;
  • construction or maintenance works;
  • government restrictions.

Guests are encouraged to obtain appropriate travel insurance to protect against unforeseen circumstances.


28. Travel Insurance

Book Jervis Bay strongly recommends that all Guests obtain suitable travel insurance prior to arrival.

The Agent and Property Owner are not responsible for:

  • personal injury;
  • illness;
  • accidents;
  • theft or loss of personal belongings;
  • travel interruptions;
  • cancellation costs;
  • circumstances preventing a Guest from travelling or completing their stay.

29. Guest Responsibility and Acknowledgement

By confirming a Booking with Book Jervis Bay, the Guest acknowledges that:

  • they have read and accepted these Terms and Conditions;
  • they are responsible for all Guests and Visitors;
  • they understand the Property is provided for holiday accommodation only;
  • they agree to comply with all reasonable instructions from Book Jervis Bay.

Failure to comply with these Terms and Conditions may result in:

  • termination of the Booking;
  • eviction without refund;
  • forfeiture of the security bond;
  • recovery of additional costs or losses.

30. Privacy Policy

Book Jervis Bay, a division of Brunswood Pty Ltd, respects the privacy of its customers and is committed to protecting personal information in accordance with applicable Australian privacy legislation, including the Privacy Act 1988 (Cth).

Collection of Information

Book Jervis Bay may collect personal information including:

  • name;
  • contact details;
  • booking information;
  • payment details;
  • correspondence history;
  • information required to manage your stay.

Information may be collected through:

  • our website;
  • email correspondence;
  • telephone communication;
  • booking platforms;
  • direct enquiries.

31. Use of Personal Information

Personal information collected by Book Jervis Bay may be used for:

  • processing and managing bookings;
  • communicating important booking information;
  • providing customer service;
  • managing payments;
  • arranging maintenance or services;
  • meeting legal and regulatory obligations;
  • improving our services.

Book Jervis Bay may also use contact information for marketing communications where permitted. Guests may unsubscribe from promotional communications at any time.


32. Disclosure of Information

Book Jervis Bay may disclose personal information where reasonably required to provide services, including to:

  • Property Owners;
  • cleaners;
  • tradespeople;
  • payment providers;
  • booking platforms;
  • service providers assisting with the operation of our business.

Personal information will not be sold or provided to unrelated third parties for marketing purposes.

Book Jervis Bay may disclose information where required by law, court order or regulatory authority.


33. Security of Information

Book Jervis Bay takes reasonable steps to protect personal information from misuse, loss, unauthorised access or disclosure.

Payment information is processed securely through approved payment providers.

Book Jervis Bay does not permanently store complete credit card details.

35. Payment Processing and Security

Book Jervis Bay uses secure third-party payment providers to process online payments.

All payment transactions are processed through secure payment systems designed to protect Guest information.

When making payments:

  • payment information may be securely transmitted to approved payment providers;
  • Book Jervis Bay does not store complete credit card details;
  • payment information is handled in accordance with applicable privacy and security requirements.

Guests acknowledge that online payment processing may involve third-party providers and agree to the terms and conditions of those providers where applicable.


36. Third-Party Booking Platforms

Book Jervis Bay accepts bookings through various booking channels and third-party platforms.

Where a Booking is made through a third-party platform, Guests acknowledge that:

  • additional platform terms and conditions may apply;
  • cancellation policies may differ depending on the booking channel;
  • platform service fees, commissions or charges are determined by the third-party provider;
  • disputes relating to platform fees or payments may need to be managed through the relevant platform.

Where there is any inconsistency between these Terms and Conditions and a third-party booking platform’s terms, the terms applicable at the time of booking through that platform may apply.


37. Website Terms and External Links

The Book Jervis Bay website provides information relating to holiday accommodation, local information and services.

While Book Jervis Bay makes every reasonable effort to ensure website information is accurate and current:

  • information may change without notice;
  • photographs and descriptions are provided as a guide only;
  • availability and pricing are subject to change until a Booking is confirmed.

The Book Jervis Bay website may contain links to external websites operated by third parties.

Book Jervis Bay does not accept responsibility for:

  • the content of external websites;
  • the availability of external services;
  • the privacy practices of third parties;
  • any loss or damage arising from use of external websites.

Guests should review the terms and conditions and privacy policies of external websites before providing personal information or making purchases.


38. Changes to Terms and Conditions

Book Jervis Bay reserves the right to update or amend these Terms and Conditions from time to time.

Any updated Terms and Conditions will apply to future Bookings made after the updated version has been published.

The Terms and Conditions applicable to a Guest’s Booking will be those provided or available at the time the Booking is confirmed.


39. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

The Guest agrees that any disputes arising from a Booking or stay at a Book Jervis Bay Property will be subject to the jurisdiction of the relevant courts and tribunals of New South Wales.


40. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be removed or limited to the extent required.

The remaining provisions will continue to remain valid and enforceable.


41. Final Acceptance of Terms

By making a Booking with Book Jervis Bay, the Guest confirms that they:

  • have read and understood these Terms and Conditions;
  • accept responsibility for all Guests and Visitors staying at or accessing the Property;
  • agree to comply with all Property rules and reasonable instructions provided by Book Jervis Bay;
  • understand that breaches of these Terms and Conditions may result in additional charges, termination of the Booking, eviction and forfeiture of monies paid.

These Terms and Conditions form part of the agreement between the Guest and:
