– BOOK JERVIS BAY –

STANDARD TERMS AND CONDITIONS FOR “HOLIDAY RENTALS”

Definitions 

“Booking” means the period for which you have paid to stay at the Property.

“Property” means the properties fixtures, fittings and equipment.

“Owner” means the owner of the Property.

“Agent / Agency” means the manager of the Property (Book Jervis Bay)

“Guests” means the person/s who stay overnight in the Property during the Booking.

“Visitor” means a person a Guest permits to visit the Property during the Booking.

Please read carefully and refer to our Property Management staff for further information.

By accepting these terms and conditions guests are being given licence to occupy the premises for the duration of the booked period only and following the conditions listed below Any breach of these terms and conditions may result in a claim at NCAT, eviction from the premises and the guests details being listed on a bad guest register.

Payment

A booking is not confirmed until the deposit of 50% is paid to the agent if you have booked within one month of arrival the total amount will need to be paid in full. All final payments must be paid in full 30 days prior to occupancy.

Bond and fees

A bond of $50/$500/$1000 (dependant on the property booked) will be taken as a pre authorisation on your card on the day of your arrival or the closest business day, this will be released in full 7 to 10 days after vacating the premises. The bond is held for the purpose of any damages to the property, furnishings, repairs, breakages, late departure (unless pre arranged with the agent), after hours call out fee. There will be a fee charged if excess garbage is left at cost, the barbeque not cleaned after use $50, and $55 for lost keys or a call out fee where spare keys are required.

Every booking is charged a one off booking fee of $50.00. You may be charged a fee if you use a third party website to make your booking, these charges are by them not us and are non refundable.

Cancellation

If a booking is cancelled prior to two months before date of arrival a fee of $50.00 will be charged and any other booking fees occurred from third party sites along with any credit card fees incurred in the process of booking. If booking is cancelled within two months of arrival you forego the whole amount if we can’t find another tenant to occupy this property for the time you have booked. If we do find another tenant then 15% of the rent and the above fees will be charged as a cancellation fee.

The booking will be made in good faith by us as the agent, however, we cannot be held responsible for actions by an owner, such as changes to a property or cancellation of a property prior to occupancy, but every reasonable endeavour will be made to offer alternative accommodation or a full refund should this situation arise. There will be no additional compensation given if this does arise

Occupancy

A reasonable number of day visitors are accepted, the number of occupants must not exceed the number stipulated on the booking form and the number of occupants the house advertises. Any breach will allow the agent to terminate the agreement immediately resulting in eviction from the property and this may result in the forfeit of the bond.

The Properties

All our property advertising, descriptions and photos are all made in good faith, we will not take responsibility for inaccurate descriptions.

Linen supplied: linen, pillows, blankets and bath towels are supplied. Further linen may be hired through the a third party supplier which the agent can and will provide details of. Beach towels are not included.

Cleaning and linen change usually occurs after your booking but can be arranged during your booking (for stays longer than 7 days) upon request and at additional cost to the guest.

Where the Property description states no linen is provided: guests must provide their own linen and towels.

Please check with our holiday management team if you are unsure of what is provided for the property you have booked -, toilet paper and some cleaning products, which are to be supplied by you the occupant.

The property must be left in a respectable manner, please ensure you have tidied the property, if you have damaged or stained any of the provided linen you may be charged a laundrette fee.

The use of the property

The properties are rented to you for holiday purposes only, as we respect you are here to enjoy your time we ask you to follow the law, if you have loud music after the permitted time or are continuing to interrupt neighbouring properties the police may be called, in result to this, you may be asked to return the keys and leave the property.

Complaints from neighbours including those of ‘partying’ are taken extremely seriously and if repeated may result in premature eviction from the property.

Please ensure noise levels are kept at an acceptable level at all times, especially between the hours of 9pm and 8am.

Check in & Check Out

Check in is 2:00pm on day of arrival. All keys are kept on premises at our Huskisson office unless in the case of a pre organised late guest arrival. In this instance key collection must be organised in advance with a member of the Book Jervis Bay staff.

Check out is 10:00am on day of departure and if the keys are returned late you may be charged a fee (unless prior arrangements have been made with the agency). Keys must be returned to the Huskisson office promptly. If keys are not returned to the office you may be charged a fee.

A clean is included in the price of your booking provided the property is left in a condition that Book Jervis Bay feel to be acceptable. If extra cleaning is required after your stay the cost of this will be charged to the guest.

If the BBQ or outdoor cooking equipment is used and not adequately cleaned then the guest will incur a fee of $50.00.

Bins are provided however if there is more rubbish than can be disposed of in these at the time of your departure then this is the responsibility of the guest. Book Jervis Bay provides information on each of the household bins to indicate the day of collection.

All damages, breakages and losses, no matter how minor must be reported immediately to Book Jervis Bay. Should you discover and damage when you arrive at your property this must be reported as soon as possible to avoid being charged for this damage.

Security

The guest agrees that at all times when not occupied the property will be secured, with all locks on all doors and windows being locked especially upon final departure.

If you have a problem securing the property please contact Book Jervis Bay before leaving the property unsecured.

Call Out Charges

If an issue resulting in a member of Book Jervis Bay staff or a tradesman visiting a property is found to be caused by the guest, guests’ visitor or equipment owned by the guests Book Jervis Bay reserves the right to pass on all charges associated to the guest.

Smoking

All of Book Jervis Bay properties are strictly non smoking. If a guest is found to have smoked inside the property they will be charged for extra cleaning and any damage costs associated with this. This may ultimately result in the loss of the guests bond.

Restricted Activities & Illegal Behaviour

The following list of activities are not allowed in any of the properties and may result in premature eviction of the tenant and the loss of bond.

  • Firework Displays
  • Use of firearms and explosives
  • Wilful damage to lawns and gardens using vehicles such as ATV’s.

Any behaviour deemed as criminal or illegal will be reported to NSW Police. Book Jervis Bay retain the right to remove all guests from the property without notice if illegal or criminal behaviour is reported or discovered.

Pets and Wildlife

Book Jervis Bay does not accept liability for the presence of any wildlife during your visit.

If staying in a pet-friendly property, please follow the same safe and responsible practices you would with your pets at home.

If you are unsure whether the property you have booked is pet-friendly, you must contact a member of staff at Oz Combined prior to arrival to confirm.

Pets are strictly prohibited in non–pet-friendly properties under any circumstances.
If a guest is found to have brought a pet into a pet-free property, this will be considered a serious breach of our Terms and Conditions. The booking will be terminated immediately, the guest will be required to vacate the property, and no refund will be issued. Additional charges will apply for any extra cleaning, damage, pest treatment, or loss of income, and this may result in the full forfeiture of the guest’s bond.

In pet-friendly properties, the following rules apply:

  • All pet waste must be disposed of appropriately and hygienically.
  • Bedding, furniture, and linen provided must not be used for pets at any time.
  • Any damage or additional cleaning required as a result of pets will be charged to the guest, including repair, replacement, and professional cleaning costs, which may be deducted from the bond.

Amendment to price or property

In certain emergency situations it may be necessary that Book Jervis Bay needs to move your booking to an alternative property. In this instance you will always be offered accommodation of at least the standard originally booked and in the most similar location possible.

In the rare event that a price is increased between your time of booking and arrival you will be offered the following three choices:

To pay the difference in tariff

To move free of charge to a similar priced property

To receive a full refund

Right of Entry

Book Jervis Bay retains the right of entry at all times to the property. This includes but is not limited to any Book Jervis Bay staff member, tradesmen or other staff members. Where possible notice will be provided.

Swimming Pools 

Swimming pool safety must be observed and complied with in accordance with legislative requirements. Guests must ensure pool access gates are secured at all times and children are properly supervised.

Complaints or Issues 

In the case of any complaints or issues, you must inform the agency during your stay so the agent or owner has the chance to rectify the issue as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours.

Any complaint which cannot be resolved locally must be notified in writing to the agent prior to your departure from the Property. Failure to follow this procedure may hinder the ability of the Agent to rectify the issue or complaint and reduce or extinguish any claim you may have.

We will not be responsible for compensation for issues that are reported late or after you vacate the property.

No compensation will be offered for disturbance or disruption to your stay where that disturbance or disruption is beyond the control of Book Jervis Bay. You will not be entitled to any form or reimbursement or compensation for departing a property early. 

Travel Insurance 

We highly recommend all guests purchase travel insurance since the Agent or Owner are not responsible for any injuries, death, illness or accidents that may occur whilst staying at the property.

By going ahead and confirming a booking with Book Jervis Bay you are agreeing to abide by the Terms and Conditions. Should you fail to comply with these conditions, your tenancy will be terminated and all rental monies including the bond will be forfeited.

In order to use the Book Jervis Bay website, we may require information from you in order to provide the best service possible.

All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including Email.

Any information collected by Book Jervis Bay is collected via correspondence from you or your company. This may be via the telephone, email, mail, fax or directly through our website.

Use of Collection Information

Any details collected from Book Jervis Bay customers is required in order to provide you with our products and/or services, and a high level of customer service.

Correspondence is recorded in order to provide service references, and to assist in our staff development.

Storage of Collected Information

The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details.

Orders

If you purchase a product or service from us, we may request certain personally identifiable information from you. You may be required to provide contact information (such as name, Email, and postal address) and financial information (such as credit card number, expiration date).

We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

Communications

Book Jervis Bay uses personally identifiable information for essential communications, such as Emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional Emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists by emailing us at holiday@bookjervisbay.com.au

You will be notified when any third party that is not our agent/service provider collects your personal information, so you can make an informed choice as to whether or not to share your information with that party.

Third Parties

Book Jervis Bay may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service.

These third parties are prohibited from using your personally identifiable information for any other purpose.

Book Jervis Bay does not share any information with third parties for any unknown or unrelated uses.

Legal

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.
